This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website at metavert.io and associated subdomains, use our applications, APIs, SDKs, AI-powered features, blockchain-based services, or engage with us through sales, marketing, or events (collectively, the "Services").

1.2 This Policy specifically addresses data practices related to artificial intelligence and agentic technology, blockchain and decentralized infrastructure, gaming and virtual economies, and website tracking technologies. This Policy is incorporated into and subject to our Terms of Service. Please read both documents carefully.

2. INFORMATION WE COLLECT

2.1 Information You Provide Directly

a Account and profile information (names, email addresses, contact data, authentication credentials);

b Content you submit, including blog comments, forum posts, support requests, and feedback;

c AI interaction data, including prompts, queries, and inputs you provide to AI Features;

d Blockchain wallet addresses and transaction identifiers you choose to associate with your account;

e Game-related data you create, including player profiles, in-game communications, and user-generated content;

f Payment and billing information when you make purchases through the Services.

2.2 Information Collected Automatically

a Device and browser information (IP address, browser type and version, operating system, device identifiers);

b Usage data (pages visited, features used, clickstream data, time spent on pages, referring URLs);

c Search query data: When you use search functionality on the Services, we collect your search inputs as they are transmitted to our servers. This data is used to deliver search results, improve search relevance, and for analytics;

d Cookie and tracking technology data (see Section 6 for details);

e Location data (approximate, based on IP address; precise location only with your explicit consent);

f Gaming telemetry data (gameplay behavior, session duration, in-game actions, performance metrics);

g API and SDK usage data, including request logs, error reports, and performance metrics.

3. HOW WE USE YOUR INFORMATION

3.1 We use collected information for the following purposes:

a Service Delivery: To provide, operate, maintain, and improve the Services, including AI Features, Blockchain Services, and gaming functionality;

b AI Processing: To process your inputs through AI models (including third-party LLMs from OpenAI, Anthropic, and others) to generate responses, content, and game features. Your AI inputs may be used to improve AI model performance, subject to the controls described in Section 4;

c Blockchain Operations: To facilitate token transactions, node operations, DePIN participation, and smart contract execution;

d Analytics and Improvement: To understand usage patterns, optimize performance, and develop new features;

e Security: To detect and prevent fraud, abuse, cheating, and unauthorized access;

f Communications: To send administrative notices, respond to inquiries, and provide customer support;

g Marketing: To send promotional communications (with opt-out capability) and deliver targeted advertising;

h Legal Compliance: To comply with applicable laws, regulations, and legal processes.

4. AI-SPECIFIC DATA PRACTICES

4.1 Third-Party AI Providers. We use third-party AI platforms to power certain features of the Services. These currently include, but are not limited to:

a OpenAI (ChatGPT, GPT models, DALL-E);

b Anthropic (Claude);

c xAI (Grok);

d Other AI/ML providers as we integrate new capabilities.

When you interact with AI Features, your inputs and contextual data may be transmitted to these providers for processing. Each provider has its own data handling practices, and we encourage you to review their privacy policies.

4.2 AI Training Data. We use aggregated and de-identified analytics derived from AI interactions to improve our Services, but we do not use your individual AI inputs to train our own models without your separate, affirmative consent. We do not sell your AI interaction data to third parties. Our API agreements with third-party AI providers are configured to opt out of provider model training where such options are available. We encourage you to review the privacy policies of the AI providers listed in Section 4.1.

4.3 Agentic AI Data Access. Where the Services deploy AI agents that autonomously perform tasks, these agents may access and process data across multiple systems and services on your behalf. AI agents operate under the same data protection standards as the rest of the Services, and their data access is limited to what is necessary to perform the tasks you request or authorize.

4.4 AI-Generated Content. Content generated by AI Features may be stored, logged, and analyzed to improve service quality and monitor for misuse. We do not guarantee the confidentiality of AI prompts or outputs.

5. BLOCKCHAIN-SPECIFIC DATA PRACTICES

5.1 On-Chain Data. Blockchain transactions are inherently public and permanent. When you use Blockchain Services, transaction data (including wallet addresses, transaction amounts, timestamps, and smart contract interactions) is recorded on the applicable public blockchain. This data cannot be modified or deleted by Metavert or any single party.

5.2 Wallet Data. If you connect a blockchain wallet to the Services, we may collect your public wallet address and associate it with your account. We do not collect or store private keys or seed phrases.

5.3 DePIN Node Data. If you operate a node on any DePIN network associated with the Services, we may collect performance data, uptime metrics, resource contribution logs, and token distribution records related to your node operations.

5.4 Data Portability Limitations. Due to the immutable nature of blockchain technology, we cannot fulfill deletion or modification requests for data that has been recorded on a public blockchain. For EEA/UK residents exercising rights under GDPR (including the right to erasure), we will comply to the extent technically feasible, which may include de-linking your account from on-chain wallet addresses, deleting all off-chain Personal Information, and terminating your account. Off-chain data associated with your account remains fully subject to applicable data rights (see Section 11).

6. COOKIES, TRACKING TECHNOLOGIES, AND CIPA DISCLOSURE

6.1 Technologies We Use. We use the following types of tracking technologies:

a Essential Cookies: Required for basic site functionality, authentication, and security;

b Analytics Cookies: Used to collect usage data and improve the Services (e.g., Google Analytics);

c Advertising Cookies/Pixels: Used for targeted advertising and campaign measurement (e.g., social media pixels, ad network trackers);

d Session Recording Tools: May be used to record and replay user interactions for usability improvement;

e Web Beacons and Pixels: Embedded in pages and emails to track engagement.

6.2 Specific Disclosure of Third-Party Data Sharing via Tracking. When you use the Services, the following categories of third-party services may receive data about your interactions:

a Analytics services (Google Analytics and similar platforms);

b Social media platforms (via embedded pixels and sharing features);

c Advertising networks (for targeted ad delivery and measurement);

d Hosting and content delivery providers;

e Search optimization and functionality providers.

6.3 California Invasion of Privacy Act (CIPA) Disclosure. This section serves as specific notice to California residents under Cal. Penal Code § 631 et seq. We do not engage in unauthorized wiretapping or eavesdropping. All data collection technologies deployed on the Services operate with your knowledge and consent:

a Consent Mechanism: When you visit the Services, you are presented with a cookie consent banner that describes the categories of technologies in use and allows you to accept or decline non-essential tracking. Your affirmative interaction with this consent mechanism constitutes your express consent under CIPA;

b Party to Communication: Metavert is a direct party to all communications that occur through the Services. Data collection by our servers and authorized service providers occurs as part of the communication between you and Metavert, not through unauthorized interception;

c Search and Input Data: When you type in search boxes or input fields on the Services, this data is transmitted directly to our servers as part of the intended function of the Services. Any third-party analytics tools that process this data do so as our authorized service providers, acting on our behalf;

d No Unauthorized Third-Party Access: We contractually require all third-party service providers to use data collected through the Services solely to perform services on our behalf and not for their own independent purposes.

6.4 Managing Your Preferences. You can control tracking technologies through:

b Browser cookie settings;

c Opt-out tools such as the Digital Advertising Alliance's opt-out page at aboutads.info/choices/;

d Device-level advertising identifier settings.

Disabling certain technologies may limit Service functionality.

7. GAMING-SPECIFIC DATA PRACTICES

7.1 Gameplay Data. We collect gameplay data including session logs, in-game actions, player interactions, achievement progress, virtual item inventories, and economic transactions within game environments.

7.2 Anti-Cheat and Fair Play. We may use automated monitoring, behavioral analysis, and AI-powered detection tools to identify cheating, exploitation, and Terms of Service violations within gaming environments. If your account is subject to automated enforcement action (such as suspension or restriction), you have the right to request human review by contacting privacy@metavert.io.

7.3 Social and Community Features. If you use in-game chat, forums, or social features, the content of your communications may be collected, stored, and moderated (including through automated AI moderation tools) to enforce community standards and applicable law.

8. INFORMATION SHARING

8.1 We may share your information in the following circumstances:

a With Your Consent: When you have given us explicit permission;

b Service Providers: With third-party vendors who perform services on our behalf (hosting, analytics, AI processing, payment processing, customer support), under contracts that limit their use of your data;

c AI Providers: With third-party AI platforms as necessary to provide AI Features (see Section 4);

d Blockchain Networks: Transaction data is shared with the applicable blockchain network as an inherent function of blockchain technology;

e Legal Requirements: When required by law, regulation, legal process, or governmental request;

f Safety and Security: To protect the rights, safety, or property of Metavert, our users, or the public;

g Business Transfers: In connection with a merger, acquisition, bankruptcy, or sale of assets, your information may be transferred to the acquiring entity;

h Aggregated/De-Identified Data: We may share aggregated or de-identified data that cannot reasonably be used to identify you.

8.2 We do not sell your Personal Information to third parties as defined under the CCPA/CPRA.

9. DATA RETENTION

9.1 We retain Personal Information for as long as necessary to fulfill the purposes described in this Policy, comply with legal obligations, resolve disputes, and enforce our agreements. Specific retention periods include:

a Account data: Retained for the life of your account plus 90 days after deletion;

b AI interaction logs: Retained for up to 90 days for service improvement, then aggregated or deleted;

c Analytics data: Retained in identifiable form for up to 26 months;

d Session recordings: Retained for up to 30 days, then deleted;

e Blockchain data: On-chain data is permanent and cannot be deleted (see Section 5);

f Gaming data: Retained for the life of the game service plus a reasonable wind-down period;

g Legal/compliance records: Retained as required by applicable law.

10. DATA SECURITY

10.1 We implement appropriate technical and organizational security measures designed to protect your information, including encryption in transit and at rest, access controls, regular security assessments, and incident response procedures. However, no electronic transmission or storage method is 100% secure, and we cannot guarantee absolute security.

11. YOUR PRIVACY RIGHTS

11.1 Rights for All Users. Depending on your jurisdiction, you may have the right to:

a Access the Personal Information we hold about you;

b Correct inaccurate Personal Information;

c Request deletion of your Personal Information (subject to legal exceptions and blockchain data limitations);

d Restrict or object to certain processing of your Personal Information;

e Data portability (receiving your data in a structured, machine-readable format);

f Withdraw consent where processing is based on consent;

g Opt out of targeted advertising and marketing communications.

11.2 California Residents (CCPA/CPRA). In addition to the rights above, California residents have the right to:

a Know what Personal Information is collected, used, and shared;

b Request deletion of Personal Information;

c Opt out of the sale or sharing of Personal Information (we do not sell Personal Information);

d Limit use of sensitive Personal Information;

e Non-discrimination for exercising privacy rights;

f Designate an authorized agent to make requests on your behalf.

Categories of Personal Information we collect (for CCPA purposes): Identifiers; internet/electronic network activity; geolocation data; commercial information; inferences drawn from other data; and professional/employment-related information where provided.

11.3 EEA/UK Residents (GDPR). If you are located in the European Economic Area or United Kingdom, our legal bases for processing include consent, contractual necessity, legitimate interests, and legal obligations. You have the right to lodge a complaint with your local data protection authority.

11.4 Do-Not-Track Signals. Because there is no uniform standard for Do-Not-Track signals, we do not currently respond to DNT browser signals. However, you can manage tracking preferences through the mechanisms described in Section 6.4.

12. CHILDREN'S PRIVACY

12.1 The Services are not directed to children under 13 years of age. We do not knowingly collect Personal Information from children under 13. If we become aware that we have collected such information, we will take steps to delete it promptly. If you believe a child under 13 has provided us with Personal Information, please contact us at privacy@metavert.io. For gaming features accessible to users aged 13–17, we comply with applicable parental consent requirements.

13. INTERNATIONAL DATA TRANSFERS

13.1 Your information may be transferred to and processed in countries other than your country of residence, including the United States, where our servers and third-party service providers (including AI providers) are located. For transfers of Personal Information from the EEA or UK, we rely on appropriate transfer mechanisms, including Standard Contractual Clauses (SCCs) approved by the European Commission and/or the UK Information Commissioner's Office, and we maintain Data Processing Agreements (DPAs) with third-party processors as required by applicable law.

14. UPDATES TO THIS POLICY

14.1 We may update this Privacy Policy from time to time. We will notify you of material changes by updating the "Last Updated" date and, where required by law, by providing additional notice (such as an email notification or prominent website notice). Your continued use of the Services after any changes constitutes acceptance of the updated Policy.
